What do you think?

I was reviewing my CC&Rs and this is the statement that they have re: pets/animals. The town of Gilbert says chickens are ok... but I would hate to go through the trouble of getting everything set up only to find out that I need to get rid of them. :o(

    Also, if it might help. I don't know if you frequent the message board on Backyard Chickens, but there is a section there all about local ordinances. There are a lot of people on BYC that have successfully changed their municipal codes. Now I know that HOAs might do things a little differently, but it could be a good way to get some additional information. Keeping chickens, luckily, is becoming less of a weird thing to do in the eyes of the public. I think you might have good luck if you can get all of your neighbors on board, but it will only take one crabby one to thwart your efforts. You know what they say about the squeaky wheel...
    • Thank you so much for your response! I agree that I don't want to be a rebel without a hen... and I really don't want to be a thorn in my HOA's side! Last thing I need is a reason for them to look more closely at things they could be fining me for.

      I also appreciated the spelled out nature... it makes it real easy for me to get started and work on this! I was planning on getting the garden started and then start hens in a few months... so this will let me get a few meetings under my belt and then propose the change!

      Is there a proper format to follow when proposing changes like this at an HOA meeting? Or do people just talk? (sorry... I really don't have a clue... lol). :o)
    • Are things like a petition of local homeowners helpful? Or do they generally hurt when talking about things like hens?
    • There are 180 homes in our HOA. I would guess about 25% are vacant or rented...
    • True... I am pretty good friends with those in my cul-de-sac, so maybe I'll start there and just say I am toying with the idea and see what they say. 3 of them are gardeners, so they may not find it as bad... but you never know.

      I am sure I'll be asking more questions... and I'll update you on my process!

    • Applause to Jeff! Well said! Thanks for elaborating on the potential to get a variance, and the best way to approach it. Urban chickens are getting more popular, and will continue to if we show that they can live in harmony with typical urban / suburban home spaces. I'm fortunate enough to live in agricultural zoning, but that also leaves the rooster, pigs, geese, option WIDE open, which my dear neighbors have done. There are advantages and challenges no matter where we live... ha ha ha...

  • Do you actually have an HOA? I'm in Mesa and not in an HOA community. We do have CC & R's though, of which most are not evenly remotely enforced (no parking on street, front wall must match house, and many others). Funny, I didn't even think to look at mine before getting chickens.

    I wouldn't mess with an HOA though. Just find someone in Gilbert that sells pastured eggs.
    • Yeah... we have an HOA... and they enforce random things... like weeds but not parking... drives me nuts.

      I think I'll just talk to my closest neighbors and get a reading... I have looked for other people in Gilbert that sell eggs for a reasonable price and unless I head to the store, it's not looking good. if there are other backyardigans, they are being super stealthy. ;o)
  • You may be able to get permission from your neighbors and get a variance from the HOA. Depends on how cool they are :) If you only have a few hens, your neighbors won't even know they are there... I assume you have a block wall?
    • Yes, I have a 6ft block wall... and no back neighbors. I have a corner lot that actually has a weird layout where I actually have over 75ft from my house to my neighbors homes on either side of my house and live on 17,000sqft... plenty of room to avoid the 80ft to my neighbors property rule. I also back up to a major road which provides more noise... possibly enough to drown out some inevitable clucking. :)
